关于CISG预期违约的分析

[摘要]《联合国国际货物销售合同公约》(简称CISG)是国际贸易领域最重要的国际统一实体法公约，其参考了不同的社会、经济和法律制度,不同的经济发展水平,不同的合同的法律制度体系,然后形成了一个相对完整的一套独立的国际货物销售合同法律制度体系,预期违约制度就是一个典型的例子。本文将研究预期违约制度的传统与发展并系统的对公约的规定评价,同时提出了对中国相关法律制度的改善。

   [Abstract] 'United Nations Convention on Contracts for International Sale of Goods' (referred to as CISG) is the field of international trade in the most important international uniform substantive law, the Convention take into account different social, economic and legal systems, different economic development levels, different legal systems of the contract system, then formed a relatively complete set of independent international sale of goods contract law system system, is expected to breach the system that is a typical example. Is expected to breach common law system is one of the traditional system, the Convention will come and make the development of its adoption. In this paper, the system of the Convention relating to the provisions of the assessment, and to the improvement of China's relevant laws were proposed.
