Disputes are inevitable, especially in commercial area. But, is litigation necessary? Of course not. Many commercial disputes can be resolved by means of arbitration and mediation, etc. These methods and some others likely make up “alternative dispute resolution”, which is usually called ADR, a means of resolving disputes beyond litigation. At present, ADR is more and more popular in America and some countries for resolving commercial disputes.
Then what’s the meaning of Alternative Dispute resolution? It was originated in America. Joanne H. Goss, a lawyer, arbitrator and chartered mediator practicing ADR in Edmonton, Canada and a teacher who give the lessons of ADR at the University of Alberta Law School said: “Alternative Dispute Resolution means the wide variety of methods by which conflicts and disputes are resolved other than through litigation.” In America, ADR programs often comprise the contents as below:………………
