死刑复核程序改革问题的探讨.doc

摘要:死刑复核程序是我国特有的针对死刑案件而设置的特殊救济程序，对于死刑复核程序在司法实践过程中暴露的种种问题与缺陷，以及在未来死刑复核程序应如何进行司法改革，学界探讨颇多。本文通过简要介绍死刑复核程序的发展历程，阐述死刑复核程序的基本概念及其实践现状，结合程序价值取向分析死刑复核程序的整体性质定位，进一步指出了该程序在司法实践过程中的缺陷并提出相关的改革对策。

Abstract:The death penalty review procedure is characteristic of our country for a death penalty case set up by the special relief program, for the death penalty review procedure in judicial practice process problems and defects of the exposure, and in the future the death penalty review procedure should be how to judicial reform, academic discussion quite a lot. This paper briefly introduced the development process of death penalty review procedure, this paper expounds the basic concept of death penalty review procedures and practice the present situation, the union value orientation program analysis the death penalty review procedure global properties positioning, and further points out that the judicial practice in the program in the process of the reform of the defects and put forward relevant countermeasures.

　　　近些年来，我国死刑的存废问题逐渐在学术界中成为一个极具争议的热点话题，同时于愈演愈烈的争论过程中，学界在死刑的存与废之间并未得出盖棺性的定论。就目前而言，我国不可能在未来的短时间内作出全面废除死刑的“文明刑罚改革”，可以看出我国对于死刑的态度更似“今存其本不忍废”。在肯定死刑将在很长的一段时间内存续下去的事实后，我们必须清醒的认识到我国死刑判决存在的问题，即如贺卫方教授所说“死亡本身具有不可逆转性，而现在的死刑判决常常存在误判，导致了许多无法挽回的严重后果。”

所以在 “少杀、慎杀”作为我国重要的死刑政策的当下，我们应该想尽办法完善死刑案件的审理程序，从而避免在死刑问题上犯错误。死刑复核程序作为死刑案件的最后一道救济程序设置，这就必然要求我们去正视死刑复核程序在实践中的种种缺陷，进而探讨死刑复核程序的改革以使其更好地发挥保障人权、限制死刑以及维护法益的作用。
