摘要:目前,我国劳动合同期限分为三种形式:固定期限劳动合同、无固定期限劳动合同和完成一定工作任务的劳动合同。长期以来,我国一直实行以固定期限劳动合同为主导的劳动合同期限制度,自2008年《中华人民共和国劳动合同法》颁布以后,我国大力推行无固定期限劳动合同。这无疑是我国劳动合同期限制度的一个巨大的进步。但是,现时我国《劳动合同法》及其相关制度对劳动合同期限问题规定得并不完备,而且存在缺失与缺陷,如:劳动合同限期制度立法理念不符合合同法原理;模式选择上脱离我国的实际国情;适用范围过宽;解除制度的松紧把握不当等,都导致实践中产生许多问题。因此劳动合同期限制度的完善有着十分重要的意义。以下我通过与法国,德国先进的劳动合同期限制度进行对比与借鉴,总结出来了完善我国劳动合同期限制度的几条建议:更新我国劳动合同限期制度立法理念;选择以稳定性为主兼顾流动性的模式;按照不同的标准来确定劳动合同期限的适用范围;在解除制度上,严格限定固定期限劳动合同的解除条件,放宽无固定期限劳动合同的解雇限制。
