论山寨现象对专利保护的冲击与应对.doc

摘要:山寨是一种模仿他人的智力成果同时又加入一定创新的行为。山寨现象的产生与我国当前的社会、经济以及法律制度现况有着密不可分的关系和影响。如何协调山寨现象与专利权之间的冲突，是司法实践也是理论研究中相对薄弱的问题。因此，研究山寨现象对专利的冲突与应对，具有一定的实践和理论意义。本文首先归纳了山寨现象的主要特点，即山寨现象具有为期短和成本低的特点。同时，山寨现象是对现有专利部分模仿、部分创新的行为，即山寨现象具有违法可能性和创新性。其次，本文分析了山寨现象对专利保护的冲击。最后，针对山寨现象的违法性和创新性，分析了山寨现象对专利权的积极和消极影响，并针对山寨现象侵犯专利权的主要制度原因，提出了协调山寨现象与专利保护的对策。

Abstract:In recent years, copycat issue has become one of the hot topics of concern at home and abroad. Therefore, it is valuable to study on copycat behavior. Copycat behavior arises from our current social, economic and legal system factors and impacts on China's current economic, legal, and cultural development. After all, the impact that conflicts and coordinate with copycat behavior and intellectual property, is more important. Firstly, this article analyses the characteristics of copycat behavior which is to imitate some of the existing intellectual property rights of innovative behavior, rather than simply counterfeiting, piracy. In addition, the copycat behavior also has a short time and low cost characteristics. Then, this cottage based on the current behavior analysis the acts of unlawful copycat behavior features of infringement in all types of intellectual property rights. Based on the cases of copycat behaviors, the article try to analyze the possibilities of the tort of the copycat behavior. Bases on the possibilities, this article analyses the shortage of China's intellectual property system in regulating the copycat behavior. Finally, I give some recommendations on Standardize the future development of the copycat behavior.

　　　山寨现象在我国的产生与发展有其一定基础条件，它体现了我国当前的经济发展情况，显示了我国中小企业发展和大众消费水平的现状。同时，它对专利权造成了严重冲击，因此，我们必须客观的看待山寨现象。对于创新性山寨行为，要引导其转变生产模式，实现经济结构转型。与此同时，应大力宣传专利权制度，让更多的中小企业提高专利权保护意识，在发展的过程中重视自身专利权的保护和积累。对于侵权性山寨行为，一方面要完善我国的专利权制度，切实有效的保护现有专利权，另一方面需要专利权人加强维护自身专利权意识，完善自身保护专利权机制，使企业专利权的保护走向制度化，达到遏制侵犯专利权行为的目的。其实，保护专利权、遏制侵权性山寨现象的举措还有利如：建立健全企业专利权保护制度、加强针对山寨现象的行政执法等等。本文在此只是抛砖引玉。在以后的学习研究中，我将继续关注山寨现象与专利权问题，并在理论上进一步深入探讨。
