论我国刑法中的立功制度.DOC

摘要:立功制度是一种独立的刑罚奖励制度，也是宽严相济的刑事政策在法律中的具体体现。由于司法实践的复杂性和多样性，现今对于立功的认定仍存在较多的分歧。本文通过对立功制度存在的问题的原因分析，进一步的指出了完善立功制度的必要性和重要性。同时，笔者从另一角度，分析了实效性对于认定立功的关键作用，借鉴了国外立功制度的相关规定，从中找出完善实效性的启示。最后，对于实现和完善立功制度的实效性提出若干建议。

Abstract:Observing system is a kind of independent punishment reward system, also is the criminal policy of tempering justice with mercy in the concrete embodiment of the law. Due to the complexity and diversity of the judicial practice, now that still exist for observing more differences. This article through to observing problems in the system of the cause analysis, further points out that the perfect system of observing the necessity and importance. At the same time, the author from another Angle, analyzes the effect that the key role for service, and using the foreign service system relevant provision, find out the actual effect of the perfect enlightenment. Finally, to realize and improve the effectiveness of the observing system puts forward some Suggestions.

　　　我国的立功制度是“立功受奖刑事政策”在刑法的体现，是宽严相济刑事政策的具体化、制度化和法律化。本文主要从发现我国刑法立功制度存在的问题，简论分析立功制度存在问题的原因，对国外立功制度的相关规定进行考察及启示，最后提出笔者完善立功制度的几点建议。我国目前的立功制度依然存在不小的问题，立法完善的道理还需要我们继续走下去。
