摘要：对未成年犯进行社区矫正，不仅了体现以人为本的司法理念，符合刑事制裁目的转变的趋势，也有利于未成年犯重新投入社会。我国的未成年犯社区矫正还处在摸索阶段，许多制度尚未完善。因此,根据我国的具体国情以及借鉴外国的先进经验入手完善未成年犯罪社区矫正制度有着现实的必要性。本文就未成年犯罪社区矫正立法的七个主要问题进行了探讨，并针对这些问题提出具体主张：制定《社区矫正法》，并设立“未成年犯罪社区矫正”专章；扩大未成年犯罪社区矫正的适用对象及范围；明确未成年犯罪社区矫正的管理主体；完善工作人员的选拔和培训、考核机制；建立社区矫正经费保障机制；制定统一的未成年犯罪社区矫正运行机制；设立符合未成年人身心特点的社区矫正项目。

Abstract:Community correction to juvenile offenders, not only the embody the people-oriented judicial philosophy, in line with the criminal sanctions purpose change trend, but also to make minor resocialization. China’s community correction system the juvenile offenders is still under construction and there is still much to be done．Therefore, according to China’s national conditions and specific reference of foreign advanced experience of community correction system to the juvenile offenders is of the practical necessity. This article gives an analysis to the improvement of China’s community correction system to the juvenile offenders from the seven main aspects and in the light of these problems specific proposal: The establishment of “community correction law”, and the establishment of the“juvenile offenders, the community correction ”chapters; Expand the juvenile offenders of community correction use object and scope; Clear the management of community correction to the juvenile offenders subject; Perfect the staff of the selection and training, examination system. Establish community correction funds safeguard mechanism; Formulate unified minor crime community correction mechanism; Set up a minor physical and mental characteristics with the community correction project.
