摘要:近年来，随着社会经济的迅速发展，我国机动车的数量成倍数增加，交通事故频繁发生，部分肇事者在交通事故后逃逸，置受害人的生死不顾，致使受害人丧失了宝贵的抢救时间，酿成惨重的伤亡后果。交通肇事后的逃逸行为不仅给事故处理带来极大的困难，而且严重危害人们的生命财产安全，违背社会伦理道义，具有严重的社会危害性。新刑法增设的“因逃逸致人死亡”的量刑，把具有独立性的交通肇事逃逸行为涵盖于交通肇事罪中，将基本犯定为交通肇事罪的结果加重犯就面临着事实和理论上的困境。本文通过对交通肇事逃逸行为的现行规定以及国内外现状比较的分析，进一步指出了增设交通肇事逃逸罪作为一个独立的罪名在我国的重要性和必要性。而且，无论我国的交通肇事逃逸问题现状以及其存在的问题，在我国增设独立的交通肇事逃逸罪都有一定的可行性。但是由于交通肇事逃逸独立成罪在我国现行法律法规中没有明确的规定，所以在司法实践中还没有明确的标准。笔者通过借交通肇事逃逸罪在国外的实践经验，对我国增设交通肇事逃逸罪提出了具体的若干建议。

Abstract:In recent years, with rapid socio-economic development, increase in the number of motor vehicles in China as multiples, traffic accidents occur frequently, some perpetrators to escape in a car accident, set the victim's life and death, regardless of loss of valuable rescue time, resulting in the victim, causing heavy casualties consequences. Escape behavior in traffic after the accident, not only to deal with the accident has brought great difficulties, and serious harm to people's lives and property, contrary to social ethics, moral, serious harm to society. New criminal code "Escape of the sentencing of additional, independent of Traffic Accident behavior covered in a traffic accident crime will be guilty of the basic set for the Crime of the consequential offense is facing the facts and theoretical difficulties. This paper the behavior of the existing provisions of Traffic Accident as well as domestic and international status quo comparative analysis further pointed out the importance and necessity of the additional traffic hit and run as an independent crime charges in China. Moreover, regardless of the traffic accident to escape the problems the current situation and its problems, have some of the feasibility of additional independent of Traffic Accident crime in our country. However, due to traffic hit and run a separate crime in the current laws and regulations not clearly defined, so no clear standards in the judicial practice. Additional traffic hit and run crime by the traffic accident to escape the crime of practical experience in a foreign country, our country, the author proposed a number of specific recommendations.
