试论经营者的安全保障义务.doc

摘要:随着市场经济的不断发展，社会的不断进步，经济的快速发展给我们带来了丰富的物质生活。但同时，我们的生活也增加了许多隐患和危险。社会公众因经营者违反安全保障义务受到人身及财产损害的事件日益增多，经营者安全保障义务问题也越来越受到学者的重视。本文首先对我国经营者安全保障义务制度存在的缺陷进行了分析，然后对国外经营者安全保障义务制度做了解析，通过借鉴国外经营者安全保障义务制度的先进经验，最后提出了完善我国经营者安全保障义务的措施。

Abstract:As the continuous development of market economy and the constant progress of the society, the rapid development of economy brings us a rich material life. But at the same time, it also brings a lot of hidden peril and risk to our lives, The incidents of harming the public's interests of person and property is increasing since business operator violates the security obligation, and more and more scholars's attentions have been paid to the problem of business operator's security obligation. This paper first to analyse the defect of the business operator's security obligation system in our country,then to analyse the foreign business operator's security system, through drawing lessons from foreign advanced experience, finally to put forward measures to perfect our country's business operator's security obligation system.
