浅谈国际私法上的最密切联系原则.doc

摘要:最密切联系原则是当代国际私法中的一种崭新理论。自二十世纪六十年代以来，它在国际上得到了越来越多的赞同和支持，被认为较好地克服了传统国际私法的种种不足，更好地适应了日益复杂的国际民事经济关系的要求，代表着国际私法未来的方向。因而研究最密切联系原则，对于丰富和发展各国国际私法制度(尤其是冲突法制度)，推进法治国家的历程，具有重大的现实意义。本文通过阐述最密切联系原则的产生与发展以及对最密切联系原则的利弊进行分析，对最密切联系原则在我国适用存在的问题提出完善建议。

Abstract:The most closely linked to the principle of contemporary private international law is a new theory in. Since the nineteen sixties, it in the world has been more and more appreciated and support, are considered better overcomes the shortcomings of traditional private international law, to better adapt to the increasingly complex international civil economic demand, represent the future trend of private international law. Therefore the research on the principle of close contact, for the enrichment and development of private international law system ( especially private international law system, promote the rule of law country ) process, has the significant practical significance. This paper explains the principle of the most closely linked to the emergence and development of the most closely linked to the principle and the advantages and disadvantages, and its related problem to study the principle of close contact, then talk about the most closely linked to the principle of applicability in china.

最密切联系原则指在选择适用于某一涉外案件的准据法时，在诸多与该案有联系的不同国家和地区的法律中，选择出与案件或当事人有最密切联系的国家或地区的法律。以合同关系为例，与传统的冲突理论相比较，最密切联系原则是一种全新的选择方法，具有较强的灵活性，给予法官较大的自由裁量权。该原则有其优点也是其缺陷，怎样规定，如何适用这一原则，各国有很大的不同。基于此，笔者打算谈谈关于最密切联系原则个人粗略的看法。
