论我国土地征收制度的完善.doc

摘要:土地征收补偿是我国土地征收制度的一个重要组成部分，也是人民保障自己的合法权益的重要规章制度。但是，就目前来说，我国的土地征收制度仍然存在诸多的缺陷与不足,从而导致了失地农民合法权益遭受严重侵害。本文通过《物权法》和《土地管理法》等法律法规进行探讨与研究，以及对现行我国土地征收方面的制度存在不足进行详细分析，来对我国《土地征收法》的制定进行思考，为完善我国土地征收法律制度提供建议。

Abstract:The Land acquisition compensation is an important of china's land expropriation system. It is also an important rules and regulations of the people to protect their legitimate interests. However, china's land expropriation system still has much defects and shortcomings for the present. This situation which led to the legitimate rights and interests of landless peasants suffered a serious infringement.This paper will mainly explore and examine the "Property Law" and "Land management Laws" and other regulation, as well as detailed analysis of the current China's land expropriation system deficiencies.In order to reflect the development of "Land  Acquisition Act", to provide recommendations for improving China's land expropriation legal system.

土地征收制度是维护公民个人利益和集体利益的一项重要法律制度，没有土地征收地址的法律体系是不完善的体系。完善土地征收制度具有深厚的理论基础，而且也有其存在的必要性和紧迫。我国在经济不断高速发展的形势下，完善土地征收制度早已成为我们广大民众的心声。但制定《土地征收法》在我国毕竟是一个新的开始，而不像修正案和司法解释那么简单，笔者以上的建议具体在实践中的效果如何仍需要进一步的检验。
