网络游戏虚拟财产法律保护探析.doc

摘要：随着网络游戏产业的迅猛发展，网络游戏虚拟财产与公民生活的联系日趋紧密。涉及网络游戏虚拟财产的法律纠纷也随之产生。但是，由于目前我国现行法律制度对网络游戏虚拟财产的保护没有明确的规定，许多纠纷得不到妥善的解决，进而导致公民的权利在受到侵害之后无法得到及时的救济。所以，为了妥善解决网络游戏虚拟财产的法律纠纷，做到切实保障公民的法律权利，应该明确网络游戏虚拟财产的财产属性，将其纳入法律调整的范围，从制度层面上保障公民的权利。基于此，本文以网络游戏虚拟财产法律保护为切入点，围绕网络游戏虚拟财产保护过程中遇到的主要困境，提出针对网络游戏虚拟财产法律保护的几点看法。

Abstract：With the development of the Network Game Industry, the virtual property spending on the network game was closely contacting with the citizen in real life. While lots of the disputes of the virtual property also caused. At present, as our country's current legal system for network game of the virtual property protection have no clear rules that many disputes are not properly solved. As a result, the citizen’s right is infringed and can not get timely relief. So, in order to solve the legal disputes for network game of virtual property and protect the citizen’s legal rights, the law to property attribute should make the rules for network game of virtual property clearly. It should take it into the legal adjustment range and guarantee the rights of the citizens from the system. The passage is analyzing the protection for the network game of virtual property at present and the main difficulties in that situation facing at. To sum up, the author tries to express some perspectives to the protection for the network game of virtual property.

 随着网络游戏产业的快速发展，网络游戏虚拟财产的经济价值日益突显，进而使网络游戏虚拟财产法律保护成为人们关注的焦点。当前，由于新兴的网络游戏虚拟财产交易市场存在许多缺陷，关于网络游戏虚拟财产法律纠纷频繁出现。但是，由于没有明确的法律制度，传统法律又无法直接适用于此类纠纷，这就导致法院在审判时不能真正做到“以法律为准绳”，受害者的权利得不到及时的救济。基于此，笔者打算就网络游戏虚拟财产法律保护谈谈个人粗浅的看法。
