试论我国行政赔偿制度的完善.doc

摘要：随着我国经济的持续发展，行政机关及行政行为在社会经济活动中的作用日益重要，但由于工作人员素质的良莠不齐，由此而引发的由于行政机关及其工作人员违法行使行政职员在行权，侵犯公民、法人或其他组织的合法权益并造成损害的事件时有发生。为了维护社会经济发展的正常秩序，建设社会主义法制，完善行政赔偿的法律法规，并且对行政赔偿法律法规进行普及宣传，对依法行政.保障行政相对人的合法权益具有重要意义。我国行政赔偿制度的建立，广泛借鉴参考了世界各国已有的行政赔偿制度，吸收了国内外有关赔偿法理论的优秀成果。但我国的行政赔偿制度毕竟建立不久，立法上不可避免地存在着一些粗疏的情况，以下笔者就行政赔偿制度在赔偿范围，规则原则等方面的完善提出几点个人的建议。

But our administrative compensation system is established soon, legislative inevitably exist some careless, the following the system of administrative compensation in the range of compensation, the principle rules and other aspects of the perfect put forward some personal suggestions.

　　　所谓行政赔偿，是指国家行政机关及其工作人员违法行使行政职责，侵犯公民、法人或者其它组织的合法权益并造成损害，而由国家承担赔偿责任的制度。行政赔偿制度，是国家赔偿制度的重要组成部分。就行政赔偿的实践来看，国家行政赔偿制度的执行还存在很多问题。像最近广州征收房屋建地铁的过程中，有一户独居老人由于认为赔偿价格过低，不配合拆迁办以及法院的工作按原规定搬迁，造成执法人员多次拆迁未果，拖延了地铁修建的进度，在最后一次拆迁日期来临之际，为防止强制拆迁，老人家在家里准备了十几罐煤气瓶，准备在执法人员强制拆迁的过程中同归于尽；但是最终在有关人员的劝说调解以及政府把赔偿金额调整到其可接受的范围下，老人家放弃了这个两败俱伤念头并且同意了搬迁以配合政府的工作。在这些行政赔偿相对人不妥协的案件中，多数是因为行政赔偿主体赔偿过低或者是赔偿范围过窄所导致的；所以说社会中存在很多行政赔偿的问题需要解决，行政赔偿制度有待完善。
