试论我国国家赔偿法的立法完善.doc

摘要：国家赔偿的原则在我国1954的《宪法》中首次确立，经过六十多年的发展与完善，逐步形成了较完善的法律体系。虽然国家赔偿法经过了修改，形成了较完整的体系，但是仍然存在一些不足之处。本文通过对《国家赔偿法》立法缺陷的发现进行立法缺陷的原因分析，以及分析完善《国家赔偿法》的必要性以及可行性，从而提出完善我国国家赔偿法的构想。

Abstract：The Principle of State Compensation in our country in 1954 of the constitution of the first established ，after more than sixty years of development and perfection, gradually formed a more perfect legal system. Although the National Compensation Law modified, formed a complete system, but there are still some shortcomings. This article through to the law of national amends the legislative found in the cause analysis of the legislative defects, analysis and perfect the law of national amends the necessity and feasibility, and then puts forward the idea of the perfect our country’s national compensation law.

　　　经过不断完善与发展，我国的国家赔偿法逐渐形成了较为完整的体系。但是，我国国家赔偿法在实际实施过程中出现了大量的问题，表现为赔偿案件少、赔偿数额低、获赔困难等等，让不少人对这部法律的信心降低。因此，笔者希望通过对我国国家赔偿法的立法缺陷进行分析与探究，从而提出完善我国国家赔偿法的构想。
