试论我国城市房屋拆迁司法审查制度的完善.doc

摘要：城市房屋拆迁司法审查制度是现代民主法治国家普遍设立的一项重要法律制度，是国家通过司法机关对拆迁人行使国家权力的活动进行审查，对违法活动通过司法活动予以纠正，并对由此给被拆迁人合法权益造成的损害给予相应补救的法律制度。本文阐述了房屋拆迁司法审查的现状和缺陷，提出完善房屋拆迁司法审查制度的必要性，并借鉴国外相关的房屋拆迁司法审查制度，从而提出对完善我国城市房屋拆迁司法审查制度的构想。

Abstract：City housing demolition judicial review system is the modern democratic country under the rule of law established an important legal system, is the country by the judicial organ to the residents to exercise state power activity are reviewed, the illegal activities through the judicial activity to be corrected, and therefrom to the legal right of the dismantled damage to give the corresponding remedy legal system. This article elaborated the housing units for judicial review of the status and defects, improve housing demolition of judicial review system is necessary, and profits from the overseas related housing demolition of the judicial review system, and put forward to perfect our judicial review system in city housing demolition conception.

城市房屋拆迁博弈事件中，被拆迁人常以极端暴力行为抗拒拆迁人的拆迁行为，以此来维护自身的合法利益。有人认为这样的被拆迁人，通过制造严重的极端行为阻碍了城市化发展；但也有人认为这些公民，是捍卫着脆弱的被拆迁者群体的合法利益。在诸多城市房屋拆迁博弈事件中，笔者认为是我国城市房屋拆迁司法审查制度尚存许多的不善之处，该制度的不完善，逐渐成为影响社会安定、阻碍和谐社会发展的重要因素。因为城市房屋拆迁司法审查制度是平衡社会利益和私人利益的有效利器，简言之，是能够起到规范行政拆迁行为的同时，又能有效保障了公民的私人权益作用，所以研究我国城市房屋拆迁司法审查制度十分必要。近年来城市房屋拆迁司法审查制度在实践过程中，其缺陷不断暴露。笔者通过本文，试谈了完善我国城市房屋拆迁司法审查制度的构想。
