摘要:随着我国工业化、城镇化建设步伐的进一步推进,农民工权益的保障逐渐受到社会各界的高度重视与广泛关注。本文以我国目前农民工劳动权益保护中存在的劳动保障法制建设滞后、劳动争议救济途径不畅与成本过大、部分用人单位有法不依及劳动用工管理混乱、农民工劳动权益执法保障力度不足、农民工自身维护能力较弱、歧视农民工的观念比较严重等主要问题为主线,深入分析其原因。通过对国外类似我国“农民工”群体权益法律保障制度的借鉴,从户籍管理制度、失业救济制度、医疗与工伤保险制度、住房与教育制度、社会保障制度五方面介绍了国外的先进经验,进而结合我国的基本国情对我国完善农民工劳动权益保障制度提出了一系列具体的建议。

Abstract:As the viaalirmvi of our country's construction step on industrialization and urbanization, the guarantee for peasant workers'rights draws more and more attention from all walks of life.This article in line with guaranteeing the rights and benefits of the off-farm workers in our country ,which existing labour security legal system construction is lagging,the relief approach of labor dispute blocked and great cost,some employing units didn't obey the law and employee management is chaotic,lacking legal guarantee institutions as for peasant workers' rights,peasant workers is weak to protect themselves,the notion of discriminating the peasant workers is severity,and other main problems at its heart to depth analysis its reason.By means of darwing references from the other countries' laws similar to legal guarantee institutions as for peasant workers' rights in China.It introduces other countries'experience of the legal guarantee for peasant workers' right in laborers' transference by way of making a simple observation of their strategies on peasant workers' unemployment and relief ,medical care ,their insurance for job injuries and retirement which China can draw some references from.The writer tries to combine with Chinese fundamental realities to put forward a series of material suggestion for Chinese legal guaranty for the labor rights and benefits of the off-farm workers.

随着农民工在社会主义建设进程中的地位日益凸显,农民工劳动权益保障问题受到党中央、国务院及各级地方政府的高度重视。在新世纪、新形势下,积极完善农民工劳动权益保护法律机制,切实保障其合法权利,是推动城乡经济社会协调发展,推进社会主义政治文明建设,构建社会主义和谐社会的一项重要内容。尽管中央及各地方政府在改善农民进城务工环境、保护农民工权益等方面出台了一系列政策措施,但目前我国对农民工劳动权益的法律保障散见于各个部门法之中。我国农民工权益法律保障现状暴露了法律的失灵问题,暴露了现行法律体系在解决侵犯农民工劳动权益方面捉襟见肘的尴尬局面,暴露了“立法不足”、“执法不严”等消极法律现象。因此,为了能够充分保障农民工的劳动权益并激发农民工的劳动积极性和创造性,加快形成系统的农民工劳动权益保障法律体系就显得尤为重要和紧迫。
