摘要:缓刑作为一种刑罚制度起源于西方，我国的缓刑制度是在清未从西方引进的，它是在总结他国经验的基础上，参考了其他国家的缓刑制度制定而成。该制度是刑罚体系中的重要组成部分，因其蕴藏着浓厚的刑法人文关怀和深厚的刑罚人道精神，与当今刑罚轻型化、社会化的潮流不谋而合，使其在现代刑法中的地位和作用越来越突出。因而本文选取我国缓刑制度的适用作为研究对象，从缓刑制度的适用的意义、缓刑适用的现状以及完善缓刑制度适用等方面进行了研究。

Abstract:Probation is a kind of penalty system originated from the western, Chinese probation system is introduced from the West in the late Qing Dynasty,which is summarized in his country on the basis of experience, a reference to other countries to develop into the probation system.The system is an important part in the system of punishment,because of its hidden with strong humanistic concern and deep criminal penalty humanitarian spirit,and the penalty light,socialization trend agree without prior without previous consultation,so that in the modern criminal law in the increasingly prominent position and role.So this article chooses our country the probation system as the research object,from the probation system,the significance of probation application present situation as well as the improvement of probation system applies and so on.
