论我国宪法监督的完善.doc

摘要:蔡定剑教授曾在《南方周末》呼吁：“宪法是拿来用的。”宪法监督制度是保障宪法实施的必要条件，也是实现法治的重要原因。我国现行的宪法监督制度在设计上拥有许多缺陷，现行宪法颁布的三十年来，几乎没有在实践中使用，可见完善我国的宪法监督制度迫在眉睫。完善我国宪法监督制度除了要依据我国的国情，更重要的是要考虑我国的政治体制和法律体制。本文通过对国内宪法监督的研究为基础，结合国外的理论和实践，以宪法监督的价值为衡量，从抽象到具体，对我国宪法监督的完善进行探讨和设想。

Abstract:Professor Cai Dingjian had at ‘the weekend’ called for:‘the Constitution is for using.” Constitutional supervision system is necessary to guarantee the enforcement of the Constitution, is also a significant cause of achieving the rule of law. Our present constitutional supervision system has many flaws in the design, the 30 years of the enactment of the current Constitution, there is little used in practice, improve the system of constitutional supervision in China is around the corner. Improve the system of constitutional supervision in China, in addition to according to the national conditions of our country; more important is to consider the political system and legal system. This paper adopted on the basis of constitutional supervision in China, combined with theory and practice, measured by the value of constitutional supervision, from the abstract to the concrete, discuss on the perfection of the Constitution and the vision.

　　　本文通过对我国宪法监督现状和宪法监督基础理论的探讨，立足我国国情，提出完善我国宪法监督的具体构想。完善我国宪法监督的现实意义是：我国现今还是存在着许多公民的宪法权利受到侵犯的事件，而现有的制度不能给予受害者有效的救济；我国还是有一些国家机关或其工作人员滥用公权力的事情发生，而我国宪法监督制度没有发挥限制其的作用。制度的完善和演进是永无止境的，我们要在坚持社会主义民主和法制原则的前提下，结合我国现行政治体制的实际情况，借鉴外国宪法监督制度中切实可行的方法，促进建立和健全一套完善的、可行的、行之有效的、具有中国特色的宪法监督制度的建立。
