试论我国城市房屋拆迁补偿制度立法完善的构想.doc

摘要:随着城乡经济的快速发展和城市建设的不断扩张，城市房屋拆迁的规模空前，与拆迁唇齿相连的行政补偿问题以及由此而引发的补偿纠纷等社会问题已经引起各级政府和社会各界的广泛关注。特别是近年来因强制拆迁引发的各种极端暴力事件更是令人触目惊心。因此从分析城市房屋拆迁补偿制度的立法缺陷入手，分析城市房屋拆迁补偿制度立法缺陷的原因，探讨了完善城市房屋拆迁补偿制度的必要性和可行性，进而提出了完善我国城市房屋拆迁行政补偿的一些基本构想。

Abstract:With our country rapid economic development and the rapid urbanization，some economically developed regions rapidly expand urban space；therefore，many urban housing demolition phenomena happened．Recently our government and people paid more attention about the the executive of housing demolition when there are compensation housing many controversies and problems about housing demolition arisen．So from the analysis of the urban house dismantlement of the compensation system of legislative defects, analysis of the urban house dismantlement compensation system of legislative defects reasons, this paper improve the urban house dismantlement compensation system of necessity and feasibility, and then put forward the improvement of the urban house dismantlement administrative compensation in our country some basic ideas.

　　随着城市发展及城镇化进程的加快，城市房屋拆迁纠纷逐渐成为社会性问题。最主要的原因之一是我国城市房屋拆迁补偿制度不完善，我国对于城市拆迁补偿的内容也只有一些原则性的规定，没有形成一套完善的城市拆迁补偿制度。本文结合目前我国城市房屋拆迁补偿制度的立法缺陷，为构建完善的城市拆迁补偿制度作一些理论上的分析和思考，为我国城市化建设拆迁中面临的实际问题提供一些新的思路和参考。
