摘要：随着社会文明的进步，科学技术的不断发展，人工代孕的技术也应运而生。与此同时在我国也相继出现，人工代孕合同作为人工辅助生殖技术的表现形式之一，对我国传统民法提出了重大的挑战。人工代孕技术作为人工生殖技术的延伸和新形式，给无数因生育功能有缺陷的家庭带来了福音，但因为人工代孕这种生育方式同时又挑战了传统的生育观念和伦理道德观念，因此也受到了广泛的争议，正确处理好有关人工代孕的相关法律问题，对于维护家庭和睦，社会和谐具有重要的现实意义和长远意义。现阶段，我国对于人工代孕技术，在立法上采取了禁止的态度，这种“一刀切”的方法使得日渐增多的人工代孕现象呈现出无法可依的真空状态；且人工代孕所生婴儿的法律父母为谁亦无法可依，不能满足司法实践的需要。结合世界各国立法模式并联系我国现实国情，论证人工代孕技术应在我国合法化的观点，承认人工代孕合同的合法性，进而提出完善我国人工代孕合同立法及其相关法律规范的方案。
