摘要：违宪审查制度的作用在于保障宪法的实施、维护宪法权威、保障公民权利与自由。但从我国实践来看，违宪审查制度始终发挥不了其作用。现行宪法生效以来，还没有从真正意义上进行违宪审查，全国人大及其常委会还从来没有宣布过一项法律、法规违宪。实际上，违宪审查制度在我国并未真正建立起来。本文从完善我国违宪审查制度必要性出发，分析我国存在着缺乏有效违宪审查的专职机构、违宪审查的范围窄、缺乏完善的违宪审查程序等问题，并借鉴世界各国实施违宪审查制度的经验，提出完善我国违宪审查制度的建议。

Abstract:The role of unconstitutional review system is to protect and safeguard the constitutional authority to protect the rights and freedoms of citizens.But our practice unconstitutional review system always can not play its role. Since the entry into force of the current constitution, has not the true sense of constitutional review, the NPC and its Standing Committee have never announced a law and the regulations unconstitutional.In fact, unconstitutional review system in China has not really set up.This article from the perfection of China's unconstitutional review system of necessity,analyze the existence of a lack of effective constitutional review of the full-time, narrow the scope of the constitutional review, lack of a comprehensive constitutional review process and other issues, and learn from the experience of the various countries in implementing the system of constitutional review, put forward views to perfect the system of unconstitutional review in China.
