摘要:小产权房的存在已久,虽然我国《土地管理法》和《房屋登记管理办法》等法律法规对小产权房交易作出了明确禁止性规定,但在实践中难以操作。小产权房的交易仍然是屡禁不止。在今年的2月21日,国土资源部在新闻发布会上宣布,今年将选择部分城市开展小产权房清理试点工作,为启动全面清理工作做好政策储备。笔者也期望小产权问题能够得到进一步或者是完全的解决。让居住在小产权房上的家庭真正拥有一套有自己合法产权的房屋。
本文首先从小产权房研究的必要性入手,分析了小产权房产生的原因,通过阐述我国小产权房小产权房存在的相关法律问题并提出相应的解决措施,以期对我国小产权房相关法律问题的解决提供有益帮助。
