试论我国公民的网络言论自由权的保护.doc

摘要:网络言论自由权，是网络主体通过互联网利用各种网络工具以各种语言形式自由地表达自己思想和观点的权利。近年来，网络社会得到高速发展的同时，为公民言论自由权与人格权、社会秩序稳定之间带来了一系列新的冲突。本文首先分析了我国目前网络言论自由的混乱现象与相关立法的缺失等问题，通过对外国网络立法的对比研究与借鉴，提出完善我国网络言论自由权的建议，从而保障公民言论自由的真正实现，维护社会的和谐与稳定。

Abstract:Network freedom of speech means that people use various Internet tools and languages to express their ideas freely. In recent years, the network society has developed rapidly.Meanwhile,it has brought about a series of new conflicts between a stable social order and the freedom of speech for citizen rights and personality rights.This thesis analyzes the current confusion of the network freedom of speech and the lack of relevant legislation and other issues.It suggests improving the Chinese network freedom of speech by learning from the legislation of foreign network and comparative research,thereby protecting the citizens of the true realization of the freedom of speech,maintain social harmony and stability.

　　　网络言论自由权是随着互联网的发展而产生的一项新兴的法律权利，公民对网络言论自由权的行使已经成为生活不可或缺的部分，但我国公民对网络言论自由权行使的现状却不尽人意，甚至引发各种法律纠纷。因此，我们必须加大对网络言论自由权的研究力度，构建一套合理完善的运行机制，使网络言论自由权发挥其积极作用，推动我国法治建设进程。
