【摘要】立功减刑制度是我国特有的法律制度，而围绕这一制度所产生的“假立功”现象是社会关注的焦点。我国现行《刑法》对有关立功行为的认定存在着不具体、不清晰的问题，在刑事司法中没有完全起到详细的指导作用，以致部分服刑人员为了达到减刑目的而通过一些非法手段为自己获取立功表现的现象存在。“假立功”现象的存在是对司法权威的严重侵蚀，破坏了立功制度本应有的社会利益与司法利益，本文从对我国的司法现状的分析入手，通过与国外法律发达国家的比较，以及对一些学者研究的借鉴，提出对我国现有立功制度有关立功认定、立功执行、立法趋势等建议和设想，力图为我国刑事司法中存在的“假立功”现象提供法律对策。

【Abstract】Observing the commutation system is the our country legal system, and the peculiar around this system produced "false observing" phenomenon is the social focus. The existing criminal law in China about the cognizance of the service behavior exist no specific, not clear problem, in criminal justice not fully play detailed guidance to serve personnel, so that part in order to achieve the commutation purposes for himself through some illegal means get rendered meritorious service exists.
