【摘要】为了制止我国司法实践中“同案不同判”现象的出现，实现“法治”的基本要求，最高人民法院提出要建立和完善案例指导制度。由于行政法自身的原因和行政诉讼实践的需要,在行政法领域内尽快建立案例指导制度十分必要。建立行政案例指导制度是实现行政法治,促进个案公正,维护形式正义的必然要求。它的建立对于弥补我国行政实体法的缺陷,摆脱行政诉讼法的困境,实现行政法制统一以及促进司法公正与效率具有重要的现实意义。本文将从案例指导制度在中国的发展现实，结合外国判例的指导意义，以构建中国特色的行政案例指导制度为目的进行一些思索。

【Abstract】In order to stop the judicial practice to the phenomenon of different codefendant, to realize the basic requirement of the "rule of law", the supreme people's court offered to build case guidance system. Because the reasons for its administrative law and administrative litigation needs of practice, as soon as established in the field of administrative law case guidance system is necessary. Administrative case guidance system is to realize the individual justice of administrative law, safeguard and promote the necessary requirements formal justice. It was created to compensate for the shortcomings of administrative substantive law, get rid of the plight of the Administrative Procedure Law, the Chief Legal Unity and the promotion of justice and efficiency have important practical significance. This article will guide the system in case the reality of China's development, combined with the guidance of foreign case law, a construction executive with Chinese characteristics and case guidance system for the purpose of some thought.
