【摘要】商标抢注令被抢注者蒙受巨大损失，影响市场经济的稳健发展，本文提出商标抢注是指抢先注册他人已使用或已注册商标的行为,其表现方式为将他人已使用的但未注册的商标在同种或类似商品或服务项目上申请注册；将他人已注册商标在该注册商标没有核定使用的商品或服务项目类别上申请注册,即进行另类注册,以此限制该商标所有人向其他领域发展的可能性。同时文章分别对保护普通商标和驰名商标提出相应的保护对策，并对我国企业如何应对商标在境外被抢注提出建议，以期构建健全的网络保护商标权利。
