内容摘要：随着经济发展和人口流动的频繁，家庭的超稳定结构逐渐被打破，家庭纷争开始上升。如何妥当解决该类婚姻家庭纠纷，成为一个现实的问题。本文试结合婚姻家庭纠纷的形成原因、自身特点和调解的独特优势分析以调解手段解决此类纠纷的必要性和实践价值，并检讨我国现行调解制度的弊端和缺陷，借鉴国外调解制度的立法与实践，以期在立法上完善调解制度，在实践中改革调解制度。

Abstract: Develop along with the economy and the population flow of multifarious, family of the super stability structure be broken gradually, the family conflict starts rising.How appropriate solve the type of marriage home of dispute, become a realistic of problem. This text tries the necessity and value that the special advantage analysis of the formation reason of combining the marriage home dispute, oneself characteristics and intermediation solves this kind of dispute by intermediation means, and examine the irregularity and blemish of our country current intermediation system, draw lessons from the lawmaking and fulfillment of foreign intermediation system with expect perfect intermediation system on the lawmaking, reform intermediation system in the fulfillment.
