内容摘要：日益频发的以酒驾、飙车等为代表的危险驾驶行为促发了关于危险驾驶行为犯罪化的讨论。对于危险驾驶行为的刑法规制应当在理解刑事违法性的基础上，区分危险驾驶行为的危险评价可能性，并以相关的客观要素为模型，厘定危险驾驶行为的主观罪过心理，从而对于缺乏社会容认性的危险驾驶行为在现行刑法体系内予以消解。而轻易的增加刑法对于危险驾驶行为的单独规定并不可行，现阶段存在难以回避的困境。本文试图从危险驾驶行为本身和犯罪化的可行性及必要性角度分析展开，阐述对于论题的见解。
