摘要：随着近几年跨国环境侵权纠纷的频频出现，如何利用冲突规则妥善地处理跨国环境侵权事件并解决由此引起的问题和纠纷已成为国际关注的热点。本课题通过对跨国环境侵权冲突规则的法律适用的研究，从比较环境侵权与一般侵权适用规则的特殊性出发，进而分别对国际统一冲突规则和各国国内特殊冲突规则分析，并借鉴目前学术界关于跨国环境侵权冲突规则法律适用的新理论学说，结合中国立法、司法实践以及相关案例，试图寻找确立完善我国涉外环境侵权纠纷冲突规则的最有效可行的方案，以期用统一明确和合理的立法规定指导我国涉外环境侵权案件关于冲突规则适用的司法实践。

Abstract: In recent years, transnational environmental frequent infringement disputes, how to properly handle conflict rules violations and address transnational environmental problems and disputes arising therefrom has become the international attention. The transnational environmental issues through the application of the law tort rules of conflict studies, comparative environmental violations from the general rules applicable to the particularity of infringement, and then were on the international harmonization of conflict rules and special rules of conflict analysis within countries, and learn about the current academic transnational environmental tort rules of conflict law applicable to the new doctrine, combined with Chinese legislative, judicial practices, and related cases, trying to find establish perfecting foreign environmental infringement dispute conflict rules of the most effective and feasible solutions to a unified clear and reasonable legislation guidance infringement cases involving foreign environment of the conflict rules apply on the judicial practice.
