论网络游戏中虚拟财产的法律保护.doc

摘要:虚拟财产的出现至今已经超过十年，在当今的网络体系里头占有者举足轻重的地位。但对于如此重要的一个存在，中国至今没有一部相应的法律对其进行明确的定位以及保护，因此关于其法律地位的确立是在是迫在眉睫。本文通过比较国内外关于虚拟财产的各种规定和学说，谈了一些自己对于虚拟财产法律地位的看法，通过分析虚拟财产的属性和权利归属等问题，主张虚拟财产是一种新型的财产权，具有物权属性的观点，在有关虚拟财产的相关法律出台之前，作者认为可以先用《物权法》里面的相应内容对其进行定性。

虚拟财产是网络游戏发展后出现的的一个名词，对于虚拟财产的法律地位也是近年来才开始备受关注的。由于虚拟财产的特殊性，其同时具有物权，知识产权，债权等的法律属性，但由由于虚拟财产的特殊性，其又具有上述类别没有的属性。同时社会中发生越来越多有关虚拟财产的争议，虽然有一些经典的法院判例，但我国并不适用判例法，司法判例无法作为法的渊源，因此，十分有必要对虚拟财产的法律地位进行定性。

　　　规范网络游戏的行业规范，对虚拟财产的法律地位予以确认是很有必要的。这种权利的确认，对于运用适当的法律规则解决虚拟财产纠纷，维护游戏玩家的正当权利，指导游戏玩家正确行使权利履行义务，都具有重要意义。
