中小企业知识产权保护探索.doc

摘要:中小企业在我国经济发展中发挥着越来越重要的作用，而知识产权的保护又是提高中小企业竞争力的重要因素。所以本文主要从政府和企业的角度去论述中小企业知识产权保护问题，由于知识产权能够提高中小企业在国内和全球的竞争力，所以本文论述了国外先进的中小企业知识产权保护政策和中小企业知识产权保护的相关环境的分析，接着提出相关的战略策略。随后本文提出了加强我国中小企业知识产权保护策略，为中小企业知识产权保护提供决策的依据。

Abstract:Small and medium-sized enterprises play an increasingly important role in China's economic development, protection of intellectual property is an important factor in improving the competitiveness of SMEs. In this paper, from the perspective of the government and enterprises，discusses the protection of intellectual property for SMEs, intellectual property rights can improve the competitiveness of SMEs in the domestic and global, this article discusses the protection policies of the foreign state-of-the-art IP for SMEs and SMEs knowledge protection of property rights related to the environmental analysis, and then put forward the strategy and tactics. In this paper, then the strengthening of SMEs in China intellectual property protection strategy. Intellectual property protection for small and medium enterprises to provide a basis for decision-making.

研究的目的与意义

　　　中小企业知识产权保护研究有利于我国中小企业加强知识产权保护,积极拥有独立自主的知识产权、加强知识产权保护意识、提高中小企业知识产权拥有量。完善我国知识产权保护制度机制。从而使得我国中小企业的创新能力得到提高和促进企业的发展。

　　　通过中小企业知识产权保护探索的研究，能有效地提高我国中小企业保护知识产权的意识；促进产业优化；提高企业核心竞争力；使国家在知识资源上形成比较优势；促进整个国家经济的发展和科技的进步，在挖掘专利、商标、版权所蕴藏的巨大潜力和财富等方面具有重要意义。

国内外研究现状

　　　国外对中小企业知识产权保护探索的研究已经到了知识产权保护制度设定和实务探讨阶段，例如欧美国家对中小企业知识产权运作及保护策略这一课题已经进行了深入广泛地研究，在中小企业知识产权保护制度运用方面的研究比较全面、规范、系统化。这些研究成果促进了他们国家对中小企业知识产权保护的重视，为知识产权竞争，抢夺制高点奠定了基础。

　　　而我国学术界对中小企业知识产权保护关注没有得到很大的重视。与发达国家相比，我国发展市场经济也就近二十年的事，在计划经济时代，由于经济体制的影响，国家将发展重点放在大中型国有企业上，在政策、资金上都没有支持，中小企业的发展举步维艰。知识产权制度在我国只有十多年的历史，就现状来说，大家都将目光放在大型企业上，中小企业的知识产权保护问题远没有得到重视，研究中也很少涉及。
