摘要:经济全球化已经成为现在这个世界的主旋律，而在世界经济的发展中，国际贸易则扮演着非常重要的角色，同时企业利益来源的源头保障在于国际货物贸易合同，但是，现实的情况却是国际贸易合同欺诈的现象经常出现，一直存在着国际货物贸易合同陷阱。因而找出贸易合同中经常存在的陷阱并进行相应的分析，从而得出应对此类陷阱的对策并加以防范就显得极为重要。本文主要通过对国际贸易合同陷阱的典型案例—LEADINGWAY GLOBAL CO.,LTD与无锡新大中薄板有限公司国际货物买卖合同纠纷上述案进行分析，得出产生陷阱的原因：包括各国相关法律规定细化程度不同、国际贸易市场监管力度不够、销售合同主体难辨和合同条款订立不完善等等，并设立遭遇合同陷阱时的应急预案来应对这些陷阱，从而提高企业对国际贸易合同陷阱的识别能力和应对手段。

Abstract: In the current era of economic globalization, economic development, international trade has become an important and indispensable component, and the presence of international trade in goods of the contract is the most fundamental guarantee business interests, but there has been trade trap, when trade fraud has occurred, and thus to identify there is often a trade contract in the trap and the corresponding analysis to arrive at strategies to deal with such a trap and make prevention becomes extremely important. This paper mainly through international trade contracts traps typical case-LEADINGWAY GLOBAL CO, LTD Sheet Co., Ltd. and Wuxi New Dazhong international sale of goods dispute case analyzed above, causes the trap draw: refinement of relevant laws and regulations, including countries varying degrees, inadequate supervision of international trade market, sales contracts and contract terms and subject to the enemy so imperfect, and analysis of results by entering into the contract, the contract, to guard against the contract management, and the establishment of an emergency contract pitfalls encountered when plans to deal with these traps, thereby enhancing the ability to identify and respond to international trade contracts means the trap.
