浅谈官员财产公开制度的现状及建设障碍.doc

摘要：纵观世界，被称之为“阳光法案”的财产公开制度在反腐倡廉建设中起到了至关重要的作用。随着我国改革开放的不断推进和人民民主法治意识的不断增强，越来越多的人开始关注这一制度。自从新疆阿勒泰的大胆试点后，全国其他各地也开始纷纷效仿。但目前在中国这一制度仍然处于初级探索阶段，制度的实施也面临着诸多阻力，本文从我国官员财产公开制度的现状出发，分析其实施的障碍，并结合我国的国情，提出相应的对策和建议，探寻完善我国官员财产公开制度的道路。

Abstract: Throughout the world, called "sunshine laws" property of the open system played a crucial role in the construction of anti-corruption. With the continuous advance of China's reform and opening up and people's awareness of democracy and the rule of law is constantly enhanced, more and more people started to pay attention to this system. Since the Sinkiang Altay bold pilot, the other parts of the country began to follow suit. This system in China is still at an early stage of exploration, the implementation of the system is also facing a lot of resistance from the status quo of China's official property of the system of open analysis of the obstacles to its implementation, and combined with China's national conditions, to propose appropriate countermeasures and suggested to explore the road of improving the official property of the public system.

　　在许多国家财产公开这一制度已经被广泛采用，每个国家财产公开制度的内容和实施方式虽然不尽相同，但是财产公开制度与生俱来的公共监督、反腐等功能和作用，对于预防国家公职人员腐败犯罪，建立廉政高效的政府具有积极意义。它是营造透明廉洁政府的基础，是铲除腐败毒瘤的利剑，是保证政府公信力的纽带，也是代议制民主的一种补充。一方面有利于弥补代议制民主中的一些缺陷，另一方面也是国家权力源于人民的象征和体现。各国的实践也证明了这项制度确实行之有效，且日臻完善和成熟。
