摘要:企业劳动争议是指劳动关系当事人之间因劳动的权利与义务发生分歧而引起的争议,可分为个人争议与集体争议、权利争议与利益争议。是在发展市场经济中是所存在的普遍现象,随着我国市场经济的不断发展和经济体制改革的不断深入,企业劳动争议处理机制无论在制度构建方面还是在实践方面都遇到了诸多问题和挑战,2007年新出台的《中华人民共和国劳动争议调解仲裁法》,新的法律确定了协商——调解——仲裁——诉讼的企业劳动争议处理机制。但也存在着明显的弊端,现行的企业劳动争议处理机制并未对权利争议与利益争议进行区分,也未根据不同的特点,制定不同的处理企业劳动争议纠纷的程序,而是采用传统的仲裁前置的传统处理模式,影响了企业劳动争议的处理速度与效率,与当前的经济发展不适应。通过横向比较,本文分析了美国、德国、英国、日本等发达国家在企业劳动争议处理机制方面的相关经验,总结我国企业劳动争议处理机制存在的弊端,从而最后提出完善我国企业劳动争议处理机制的若干意见:完善法律法规,建立公平公正的处理机制;改革“一调一裁两审”的体制,实行“三方机制”;完善劳动争议的协商、调解、仲裁、诉讼机制,确保其法律地位;设立劳动法庭,提高诉讼效率。

Abstract:Enterprise labor dispute refers to the labor relations between the parties due to the labor rights and obligation produces difference and controversy. The new law determines the consultation—mediation—arbitration — Proceedings of the enterprise labor dispute processing mechanism. But there are also disadvantages,the current enterprise labor dispute processing mechanism does not dispute the rights and interests of the controversial distinction between, also according to the different features, different processing enterprise labor dispute procedures, instead of using the traditional arbitration front the traditional model, influence enterprise labor dispute processing speed and efficiency, and the current economic development.
