摘要:无固定期限的劳动合同是劳动合同的一种重要类型。它事关广大劳动者和用人单位的实际利益,对劳动关系的稳定与和谐影响甚大。《劳动合同法》虽然针对当前劳动用工领域存在的不良现象,通过完善无固定期限劳动合同制度,加大了对劳动者的保护力度,体现了以“保护劳动者合法权益”为核心的立法宗旨,但仍然还存在很多不明确的地方,如有关合同订立的条件、形式和适用主体的规定以及合同解除的条件、程序和法律后果的规定都有很多漏洞,致使在实践中引起不少争议,使得无固定期限劳动合同虚化和劳动合同短期化现象严重的问题也仍然难以得到有效解决。有鉴于此,本文对无固定期限劳动合同进行了深入探讨。

   本文从无固定期限劳动合同的重要地位切入,提出了无固定期限劳动合同在理论和实践中存在的若干代表性问题,分析了产生上述问题的原因和特点,运用对比等方法阐述了国外在实施劳动合同方面的一些做法及可以借鉴之外,对完善无固定期限劳动合同提出了自己的建议和对策。

Abstract:Without a fixed term labor contract is an important type of labor contract. It is related to the broad masses of workers and employers of the practical benefits of stable and harmonious labor relations great impact. "Labor Contract Law," Although the field of labor and employment for the current existence of undesirable phenomena, through the improvement of non-fixed term labor contract system, and increased worker protection, reflects the "protection of legitimate rights and interests of workers" as the core of the legislative purpose However, there are still many uncertainties, such as the contract terms, form and application of the provisions of the principal and the contract to lift the conditions, procedures and legal consequences of have a lot of loopholes, with the result in practice led to many arguments making false labor contract without a fixed term labor contracts of short-term phenomenon and serious problems remain difficult to solve. In view of this, the paper has no fixed term labor contract was in depth. 

   This article cut into from the not fixed deadline work contract important status, proposed the not fixed deadline work contract certain representative question which existed in the theory and the practice, analyzed has had the above question reason and the characteristic, using methods and so on contrast elaborated beside overseas and might profit from in implementation work contract aspect some procedures, put forward own proposal and the countermeasure to the consummation not fixed deadline work contract.
