试析媒体监督视域下地方政府的强制拆迁.doc

摘要： 由媒体报道有关拆迁的新闻几乎每天都能找到，这样平常的事件却被屡屡曝光，这背后肯定存在着它的不平凡。本文就通过地方政府的强制拆迁这一视角，来研究媒体监督对政府职能实施过程中所起到的作用以及他们之间的关系，并总结媒体监督所取得的成绩，找出存在的问题，通过分析存在问题的原因，来试图加强和完善我国的媒体监督体制。

Abstract: By media reports about the demolition of the news can be found in almost every day， so common for the event have been repeatedly exposed， which certainly exists behind the extraordinary. This article is through the perspective of local Government forced building demolition，for the study of media supervision on government functions in the implementation of the role of and the relationships between them and to review the achievements of the media supervision， identify existing problems， by analyzing the problem exists because， in an attempt to strengthen and improve the supervision system of China's media.

　　 目前我国关于对强制拆迁的立法有三种情形：第一种，拆迁人同被拆迁人之间达成仲裁协议的，并且仲裁委员会做出裁决，被拆迁人应当履行搬迁的，那么，拆迁人可以向人民法院申请执行仲裁委员会做出的拆迁裁决，对被拆迁人进行强制拆迁。第二种，拆迁人向人民法院进行起诉，由人民法院做出相应的判决，并且通过司法程序对被拆迁人进行强制拆迁。第三种，拆迁人向行政机关申请裁决，被拆迁人在裁决规定的搬迁期限之内未履行搬迁的，拆迁人可以向行政机关提出申请对其进行强制拆迁。这三种立法程序中，前两种的强制拆迁是属于司法强制拆迁程序，最后一种是属于行政强制拆迁程序。
