摘要:食品召回法律制度起源于美国等发达国家,并在其多年的实践中得以逐步完善。近几年来,我国食品安全事故频繁发生,作为食品安全监管体系重要组成部分的食品召回法律制度也得到人们的高度重视。而我国建立食品召回法律制度起步较晚,有关食品召回法律制度的法律法规不够成熟完善。本文首先对完善我国食品召回法律制度的必要性进行阐述;然后,就我国食品召回法律制度存在的问题进行分析;通过借鉴美国食品召回法律制度的成功经验,提出完善我国食品召回法律制度的建议。

Abstract:Food recall system originated in the United States and other developed countries, and has been gradually improved in practice for many years. In recent years, increased incidents of food safety in the People's Republic of China has raised awareness of Chinese citizens to the issue. However, food recall system in China has emerged relatively late, and the relevant laws and regulations of the food recall system is not mature enough. Firstly, the paper discusses the necessity of food recall system. Then, it analyzes the exist defects in the food recall system of China. Finally, it puts forward proposals of improving the food recall system of China on the basis of learning from the advances on the food recall system of United States.

食品安全问题关系到广大人民群众的人身健康与切身利益,关系到国民经济发展与社会稳定。实践证明,完善的食品召回法律制度在保障消费者的合法权益、增强食品企业的综合竞争力、保障食品安全、促进和谐社会建设等方面发挥着越来越重要的作用。我国的食品召回法律制度才刚刚起步,仍需进行不断的探索和完善。对于食品召回法律制度而言,不仅需要立法技术层面的完善,更需要与之相配套的各项制度及实施细则的完善。笔者相信,随着我国食品召回法律制度实践深入开展,食品召回法律制度将会逐步完善起来,从而发挥食品安全的保护作用,构筑保障消费者食品安全的最后一道防线。
