摘要:刑法对转化型抢劫罪的规定非常简约和概括，相关司法解释也并不十分明确，无论是刑法学理论界还是司法实务部门对于转化型抢劫罪的犯罪构成与适用问题还存在较大的争议。本文通过对转化型抢劫罪的前提条件和适用两个方面进行分析，重点探讨转化型抢劫罪的前提条件是否有数额限制，特殊类型的盗窃、诈骗、抢夺罪能否转化为抢劫罪，转化型抢劫罪的犯罪形态和共同犯罪形态这四个热点争议问题，并指出转化型抢劫罪需要得到进一步的立法完善。笔者根据刑法理论界和司法实务界对转化型抢劫罪的相关主张及借鉴国外对该罪的立法与实践，对转化型抢劫罪的立法完善提出若干具体的建议。

Abstract:The Criminal Code provisions of transformation robbery is very simple and summarized its provisions, relevant judicial interpretations are not very clear. Theoretical circles in the legal and judicial practitioners have different ideas about the tansformation robbery constitution and its application. This paper base on research the prerequisite of the transformation and its application of the law, focus on wehter its prerequisite have restraint; whether specil burglary,fraud or seize is converted into robbery or not; the transformation robbery cirme patterns and common patterns of crime this four questions. And further pointed out that the transformation robbery need to be improved. According the different ideas of the theoretical circles in the legal and judicial practitioners and referring to foreign legislation and practice of the crime. Author make some specific suggestions about the transformation of leigislative improvement.
