摘要：在保险市场中保险代理是一项重要组成部分，居于保险合同双方当事人之间，它起到节约交易费用、提升保险产品服务、提高保险人经营水平等作用。随着保险事业的发展而日显突出，寿险人的诚信制约着保险事业更高层次发展。基于此，本文主要对保险代理基本法律关系阐释和分析的基础上，深入探讨了保险代理权行使、保险代理行为的责任归属、保险代理人的诚信缺失与治理、保险代理监管等针对性问题，以期在进一步完善保险代理制度体系的同时，还能解决实践认识有所帮助。

Abstract: In the insurance market, insurance agent is an important part of living in the insurance contract between the parties, which played to save transaction costs, improve the insurance products and services, enhance the role of insurers operating level. With the development of the insurance industry more obvious each day, which restricts the insurance industry a higher level. Based on this, this paper, the basic legal relationship between the insurance agency interpretation and analysis, based on the depth of the exercise of the right insurance agent, insurance agent behavior of accountability, lack of insurance agents and the integrity of governance, insurance agents and other specific regulatory issues, with a view to further improve the institutional system, while the insurance agents, can help solve practical knowledge.
