论票据善意取得的适用范围.doc

摘要：本文研究的主要问题是票据善意取得的适用范围。第一部分是票据善意取得的概述，讲述的是善意取得和票据善意取得的内涵；第二部分是对票据善意取得的适用范围进行研究；第三部分对票据善意取得的适用范围存在的问题及影响进行探讨；第四部分则是在参考许多学者的优秀文章后提出了本人关于完善票据善意取得适用范围的建议，期望能对我国票据善意取得制度的发展做出微薄贡献。

Abstract :　This paper focuses on the application scope of bona fide acquisition of bills. The first part is the introduction of bill bona fide, it tells the concept of the bona fide acquisition and bona fide acquisition of bills ; the second part study on the application scope of bona fide acquisition ; the third part discusses the problems and influence of scope of bona fide acquisition ; the fourth part is in reference to many scholars＇own excellent articles , and give some advice, looking forward  to make a modest contribution to China's legal system of the application scope of bona fide acquisition of bills’ development .

　　票据善意取得适用范围在票据法中是很令专家学者头疼的问题。在实务中，如果保护了票据债务人的利益，票据的安全得到保障，但是善意持票人的利益就会遭到损失。相反，如果维护善意持票人的利益，那票据债务人的利益则得不到保障。如何既保证票据的流通性又保护票据交易的安全是十分重要的问题，本文旨在通过作者的浅显分析，研究探讨票据权利善意取得适用范围的相关问题，并对司法等提出一些自己的观点。
