摘要:目前,口供仍是我国刑事诉讼法中一种重要的刑事证据。口供在刑事证明中具有特殊意义,是借助于被告人这个主体的主观活动间接的再现客观事实,由于人的趋利避害的本性,使口供具有真实性与虚假性并存、不稳定性等特点。因此,在对待即使是依法取得的口供的态度上,我国刑事诉讼法也强调遵循“重证据,重调查研究,不轻信口供”的精神,裁断被告人是否有罪,不是被告人是否作出有罪供述,而是证据是否确实充分。
本文从四个方面展开。首先从口供的基本概念入手,概述我国刑事诉讼法中的口供的含义和外国证据法中的口供概念及分类,指出我国刑事诉讼制度上口供的表现形式及其特点。其次通过对美国非法口供排除的规则的介绍,解析我国非法口供排除制度的创新和突破——“两个规定”。同时对口供补强制度的含义和价值进行分析。最后,为了使我国刑事诉讼从根本上杜绝刑讯逼供,在保护人权和打击犯罪之间寻求平衡点,使诉讼更加符合现代司法文明,在制度层面为口供的获取设计一套可供参考的措施。

Abstract: At present, confession still acts as the important criminal evidence in Criminal Procedure Law.It plays a significant role in criminal proving by recurring the objective facts with defendant’s subjective activities. With the human nature named seeking profit and avoiding loss, the characters of confession is the coexistence of truth and falsity, instability and so forth. Therefore, even dealing with the confessions obtained according to law, the criminal procedure law follows the spirit “the evidence, investigation and research, incredulity to confession”. Judging whether the accused is guilty or not isn’t based on whether the defendant admitted his guilty,but whether the evidence is ample.
This paper consisted four parts. In the first part, we compared the definition of confession between China Criminal Procedure Law and Evidence Act abroad, pointing out manifestation and characteristics of confession in criminal procedure. Secondly,after introducing exclusionary rules of illegal oral confessions of the US.analysis Innovations and breakthroughs of our exclusionary rules of illegal confessions—“Two provisions”. At the same time analyze the meaning and value of confession reinforcing system.In the and,to make our Criminal Procedure prevent torture From the root,find the balance point between humam rights protection and the fight against crime,make procedure more in line with modern judicial civilization and designing a feasible measure for the obtaining of confession at the level of system.
